Legal terms and conditions for using BigStar Pay services
1. Acceptance of Terms
By accessing and using ILYA BIG STAR's cryptocurrency exchange services, you accept and agree to be bound by these terms and conditions. If you do not agree to these terms, please do not use our services. These terms constitute a legally binding agreement between you and ILYA BIG STAR LIMITED LIABILITY COMPANY.
2. Service Description
ILYA BIG STAR provides regulated cryptocurrency exchange services including:
- • Secure storage and management of virtual currencies
- • Cryptocurrency wallet services with institutional-grade security
- • Conversion between fiat currencies (EUR) and cryptocurrencies
- • Bank wire transfer processing for deposits and withdrawals
- • Custody services for digital assets
- • Compliance with EU and Polish regulatory requirements
3. Regulatory Compliance
Our services are provided in compliance with:
- • Polish Act on Virtual Currency Services
- • Act on Counteracting Money Laundering (2018)
- • EU 5th & 6th Anti-Money Laundering Directives
- • General Data Protection Regulation (GDPR)
- • Polish Financial Supervision Authority requirements
- • European Banking Authority guidelines
- • FATF recommendations and standards
- • Consumer protection regulations
4. User Obligations & Eligibility

- • Be at least 18 years old and legally capable of entering contracts
- • Complete mandatory KYC/AML verification procedures
- • Provide accurate and truthful information during registration
- • Comply with all applicable laws in your jurisdiction
- • Maintain security of your account credentials and private keys
- • Report suspicious activities or security breaches immediately

- • Providing services to sanctioned individuals or entities
- • Market manipulation or fraudulent trading practices
- • Circumventing AML/KYC procedures or identity verification
- • Using our services from prohibited jurisdictions
- • Violating intellectual property rights or third-party rights
5. Risk Disclosures

- • Market Risk: Cryptocurrency values can fluctuate significantly and unpredictably
- • Liquidity Risk: You may not be able to sell your cryptocurrencies at desired prices
- • Technology Risk: Blockchain networks may experience technical issues or hard forks
- • Regulatory Risk: Future regulations may affect the value or legality of cryptocurrencies
- • Cybersecurity Risk: Digital assets may be subject to hacking or technical vulnerabilities
- • Loss Risk: You may lose some or all of your invested capital

6. Service Availability & Interruptions
While we strive to maintain 24/7 service availability, we cannot guarantee uninterrupted access. We reserve the right to suspend services temporarily for maintenance, security updates, regulatory compliance, or system upgrades. We are not liable for losses resulting from planned or unplanned service interruptions.
7. Fees & Transaction Costs
Our fee structure includes but is not limited to:
- • Trading fees for cryptocurrency exchanges
- • Deposit and withdrawal processing fees
- • Network fees for blockchain transactions
- • Currency conversion fees for international transactions
- • Premium services and enhanced support fees
Current fee schedule is available on our website and may be updated with advance notice.
8. Account Suspension & Termination
We reserve the right to suspend or terminate accounts in the following circumstances:
- • Violation of these Terms of Service or applicable laws
- • Failure to complete or maintain valid KYC/AML documentation
- • Suspected fraudulent, illegal, or suspicious activities
- • Regulatory or legal requirements
- • Extended periods of account inactivity
- • Technical security concerns or account compromise
9. Limitation of Liability
ILYA BIG STAR's liability is limited to the maximum extent permitted by Polish and EU law. We shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities. Our total liability shall not exceed the amount of fees paid by you in the 12 months preceding the claim.
10. Dispute Resolution
Governing Law: These Terms are governed by Polish law.
Jurisdiction: Disputes shall be resolved by Polish courts in Warsaw.
Alternative Dispute Resolution: We encourage resolution through our customer service team before pursuing legal action.
11. Changes to Terms
We may modify these Terms of Service from time to time. Significant changes will be communicated via email and website notification at least 30 days in advance. Continued use of our services after changes take effect constitutes acceptance of the modified terms.
